CAW CELL DELHI: एक matrimonial complaint में सिर्फ husband नहीं — पूरा family circle भी case में आ सकता है.

Look at a Delhi High Court order dated 31 August 2026.

In Vinod Prajapti & Ors. v. State (Govt. of NCT of Delhi) & Anr., CRL.M.C. 6350/2026, the FIR was registered at Police Station Crime (Women) Cell, Nanak Pura, Delhi, under Sections 498A/406/34 IPC.

The case is important because of who was named.

It was not only the husband.

The petitioners included:

Petitioner No.1 — husband

Petitioner Nos.2 & 3 — parents of the husband

Petitioner Nos.4 & 6 — brothers of the husband

Petitioner Nos.5 & 7 — sisters-in-law

That means seven members of the family were before the High Court in connection with the FIR.

The marriage had taken place on 5 May 2017.

The parties had been living separately since February 2018.

The wife had first made a formal complaint before the Crime Against Women Cell, which subsequently resulted in registration of the FIR.

But years later, the circumstances changed.

The parties entered into a Memorandum of Understanding/Settlement Agreement dated 21 September 2024.

The husband and wife reconciled.

They were living together again.

And importantly, they had two minor children.

The Delhi High Court recorded that the parties had been living together for about two years and that their second child had been born after reconciliation.

The Court ultimately held that, in those particular circumstances, continuation of the criminal proceedings would not serve a meaningful purpose and quashed FIR No. 46/2019 and all consequential proceedings.

Now look at the practical lesson.

When a CAW CELL DELHI complaint is filed, a husband should not think:

“बस मेरी wife की complaint है.”

You need to immediately find out:

Who exactly has been named?

What allegations are attributed to each person?

Which allegations actually concern the husband?

Which concern the parents?

Which concern siblings or their spouses?

What documents support or contradict each allegation?

Because a matrimonial dispute can sometimes bring parents, brothers, sisters-in-law and other relatives into the same criminal proceeding.

And once someone's name appears in an FIR, the consequences are no longer merely a private family disagreement.

This case also shows something else:

A case that begins in CAW Cell may ultimately reach the Delhi High Court.

So don't wait until every family member is trying to understand the case separately.

Build the chronology.

Separate each person's role.

Preserve messages and documents.

Record dates of complaints and proceedings.

Understand exactly what has been alleged against each person.

And if settlement discussions begin, understand precisely what is being settled and which proceedings are actually covered.

This is not a statement that every CAW Cell complaint is false.

It is a warning about procedural exposure.
