MEN CELL IN DELHI : 1 YEAR WAITING PERIOD FOR DIVORCE IS WAIVED OFF UNDER ARTICLE 142 OF CONSTITUTION OF INDIA

Men Cell Delhi: शादी हुई, लेकिन साथ रहना शुरू ही नहीं हुआ — फिर Divorce के लिए 1 साल क्यों?


“शादी तो हो गई… लेकिन हम कभी साथ रहे ही नहीं। अब अगर दोनों अलग होना चाहते हैं, तो फिर भी पूरा एक साल क्यों wait करें?”

यह सुनने में अजीब लगता है, लेकिन हर marriage की कहानी honeymoon, shared home और family photographs से शुरू नहीं होती।

Delhi High Court के सामने एक ऐसा ही unusual case आया। Husband और wife अलग-अलग faiths से थे और उन्होंने 25 August 2025 को Delhi में Special Marriage Act के तहत marriage register कराई थी। लेकिन marriage के बाद दोनों कभी साथ रहे ही नहीं। न cohabitation हुआ, न consummation और न ही दोनों families में marriage की social acceptance हुई।

फिर situation और complicated हो गई।

Husband के family members को marriage की जानकारी मिलने के बाद उसके father की health गंभीर रूप से खराब हो गई और family ने उससे relations sever कर दिए। दूसरी तरफ wife ने भी अपनी family से marriage छिपाई हुई थी, क्योंकि उसे अपने घर में similar rejection का डर था.

दोनों eventually इस conclusion पर पहुँचे कि यह marriage practically शुरू ही नहीं हो पाई और दोनों इसे खत्म करना चाहते हैं।

लेकिन Family Court ने statutory waiting period waive करने की request स्वीकार नहीं की।

फिर मामला Delhi High Court पहुँचा।

और यहाँ Court ने एक important distinction किया — कानून में waiting period है, लेकिन exceptional circumstances में Court के पास उसे waive करने की discretion भी है।

High Court ने माना कि जहाँ marriage purely notional रह गई हो, parties कभी साथ रही ही न हों और दोनों dissolution के लिए agree हों, वहाँ हर situation में mechanically one-year period insist करना जरूरी नहीं है। इस particular case में family estrangement, father's serious medical condition और surrounding circumstances को exceptional hardship माना गया.

अब इसे Men Cell Delhi search करने वाले किसी husband की नजर से देखिए।

कभी-कभी आदमी सोचता है, “Marriage certificate तो बन गया, अब चाहे कुछ भी हो, एक साल तो निकालना ही पड़ेगा।”

लेकिन law में कुछ situations ordinary नहीं होतीं।

और इसका उल्टा भी समझिए — इसका मतलब यह नहीं कि कोई भी newly married couple कहे, “हमें शादी पसंद नहीं आई, waiting period हटा दीजिए”, और Court automatically मान जाएगी।

Delhi High Court ने साफ किया कि waiver exceptional circumstances में judicial discretion का मामला है; यह कोई automatic right नहीं है.

यही distinction Mencell Delhi या Purush Aayog Delhi search करने वाले व्यक्ति के लिए बहुत important है।

अगर marriage अभी शुरू ही नहीं हुई, parties कभी साथ नहीं रहीं, कोई child नहीं है और दोनों genuinely अलग होना चाहते हैं, तो अपनी situation को ordinary matrimonial dispute की तरह देखने से पहले applicable law और facts को समझना जरूरी है।

और अगर आपका search है “where can a husband complain against wife?”, तो एक और बात याद रखिए — हर difficult marriage का answer complaint नहीं होता।

कभी problem यह होती है कि marriage itself practically collapsed before married life even began.

कभी दोनों parties agree होती हैं लेकिन procedure रास्ते में आ जाता है।

और कभी husband जल्दी में कोई ऐसा कदम उठा देता है जिससे simple separation unnecessarily complicated हो जाती है।

इस case में सबसे interesting बात यही थी कि marriage legally exist करती थी, लेकिन married life practically शुरू ही नहीं हुई थी।

कागज पर marriage थी।

Ground reality में shared life नहीं थी।

और Court को इसी difference को देखना पड़ा।

यही कारण है कि अगर आपकी शादी के बाद cohabitation शुरू नहीं हुई, दोनों अलग हैं, कोई child नहीं है, families में marriage स्वीकार नहीं हुई या circumstances इतने unusual हैं कि marriage को continue करना practically impossible हो गया है, तो “एक साल तो हर हालत में लगेगा” जैसी blanket advice पर भरोसा मत कीजिए।

अपने documents निकालिए। Marriage registration देखिए। Date of marriage note कीजिए। Cohabitation हुई या नहीं, इसका factual record समझिए। दोनों parties की present position साफ रखिए।

क्योंकि Family Court में emotion अपनी जगह है, लेकिन facts की chronology बहुत कुछ बदल सकती है।

और हाँ, ऐसे cases में भी जल्दबाजी मत कीजिए। कोई fake document, false allegation या manufactured story बनाकर “exceptional hardship” साबित करने की कोशिश situation को और खराब कर सकती है।

सच जितना unusual हो, उसे उतना ही साफ तरीके से document करना जरूरी है।

अगर Delhi या Delhi-NCR में आपकी marriage practically शुरू ही नहीं हुई, Special Marriage Act के तहत marriage हुई है, mutual separation की स्थिति है, या Family Court ने statutory waiting period को लेकर आपकी application reject कर दी है, तो अगली तारीख तक simply wait मत कीजिए।

कभी-कभी legal problem का सबसे बड़ा हिस्सा law नहीं, बल्कि यह मान लेना होता है कि “procedure तो हर case में same ही होगा।”

Case-specific caution: इस Delhi High Court ruling का आधार उस particular couple की unusual circumstances थीं—no cohabitation, no consummation, no child, lack of social/familial acceptance, mutual willingness to dissolve the marriage and exceptional hardship. इससे यह नहीं माना जा सकता कि हर newly registered marriage में one-year statutory period automatically waive हो जाएगा.
