CAW CELL DELHI: Stridhan List में Jewellery और Articles का Claim हो तो क्या करें?
उस moment पर husband को दो तरह के pressure का सामना करना पड़ सकता है।
एक तरफ डर कि कहीं किसी article को लेकर 498A/406-related allegation या criminal breach of trust का आरोप न लग जाए।
दूसरी तरफ frustration: “इतनी सारी चीजें लिखी हैं—मुझे कैसे पता कि इनमें से कौन-सी मेरे पास है, कौन-सी wife ले गई थी और कौन-सी कभी मेरे possession में थी ही नहीं?”
यही वह stage है जहाँ CAW Cell Delhi में emotional reaction से ज्यादा important एक accurate, item-by-item record हो सकता है।
एक List का मतलब यह नहीं कि हर Article आपके Possession में है
मान लीजिए CAW Cell Nanakpura या CAW Cell Seema Puri में matrimonial complaint के दौरान आपको jewellery और stridhan की list दी जाती है।
उसमें gold ornaments, silver articles, clothes, gifts, electronic items या household goods लिखे हैं।
आपको तुरंत पूरी list को accept या reject करने की जरूरत महसूस हो सकती है।
लेकिन blanket denial भी risky हो सकता है और बिना verification के blanket admission भी।
हर article के लिए अलग question पूछिए:
- क्या यह article वास्तव में मौजूद है?
- क्या यह wife का personal property/stridhan है, joint household item है या किसी दूसरे family member का gift/property है?
- क्या article अभी husband या किसी relative के possession में है?
- क्या article पहले ही वापस किया जा चुका है?
- क्या उसके return का कोई receipt, message, photograph या witness available है?
- क्या article की ownership या quantity disputed है?
हर item का factual status अलग हो सकता है।
इसलिए केवल “सब सामान मेरे पास नहीं है” लिखकर आगे बढ़ जाना भी पर्याप्त नहीं हो सकता, खासकर जब कुछ items वास्तव में आपके पास हों और उन्हें return किया जा सकता हो।

आपका उद्देश्य counter-list को बड़ा बनाना नहीं होना चाहिए। आपका उद्देश्य उसे accurate बनाना होना चाहिए।
अगर कोई article मौजूद नहीं है, तो उसे केवल strategy के नाम पर अपनी list में मत डालिए।
अगर कोई article आपके possession में है, तो केवल इस डर से उसकी existence deny मत कीजिए कि complaint में उसका mention हुआ है।
और अगर किसी article का status genuinely uncertain है, तो उसे verified fact की तरह प्रस्तुत करने के बजाय उस uncertainty को properly record करने के बारे में legal advice लीजिए।
Return करते समय सबसे बड़ी गलती: कोई Proper Receipt न लेना
अब दूसरी situation समझिए।
आपके पास कुछ jewellery या personal articles वास्तव में मौजूद हैं और आप उन्हें return करने के लिए तैयार हैं।
लेकिन कोई कहता है:
“अभी सामान दे दीजिए, receipt बाद में बन जाएगी।”
या:
“बस CAW Cell में दे दीजिए, record अपने-आप बन जाएगा।”
या:
“आपको receipt की क्या जरूरत है? सबके सामने return हो रहा है।”
ऐसी informal handover process से बचना समझदारी है।
क्योंकि बाद में dispute हो सकता है कि कौन-सा article return हुआ, कितनी quantity थी, किस date को handover हुआ और कौन-सी items अभी allegedly outstanding हैं।
इसलिए, जहाँ practical और legally appropriate हो, handover से पहले itemised inventory, date, quantity, condition, receiving signature और acknowledgement की व्यवस्था करें।
अगर articles police station, CAW Cell या mediation centre में return किए जाने हैं, तो process पहले से concerned authority और अपने legal adviser के साथ clarify करें।
Supreme Court का एक practical example
15 May 2026 के Gauri Nautiyal v. Siddhant Dimri matter में Supreme Court ने parties के mediated settlement की terms record कीं। Settlement में stridhan jewellery/articles की list Annexure-1 में identify की गई और return के लिए date, place तथा दोनों parties के advocates की presence तय की गई। Clothes भेजने के लिए अलग deadline भी रखी गई। citeturn970981view0
यह एक specific settlement था, हर CAW Cell case के लिए mandatory format नहीं।
लेकिन practical lesson स्पष्ट है:
“सामान वापस कर दिया” कहना और यह record करना कि कौन-सा सामान, कब, किसे और किस acknowledgement के साथ दिया गया—दो अलग बातें हैं।
NRI Husband के लिए यह और भी important है
अगर husband Dubai, USA, UK, Canada या किसी दूसरे country में रहता है और उसके parents Delhi में हैं, तो articles की possession को लेकर confusion बढ़ सकता है।
उदाहरण के लिए:
- Jewellery allegedly mother-in-law के locker में थी।
- Clothes किसी अलग residence पर रखे थे।
- Household items दूसरे family member के घर shift हुए थे।
- कुछ articles wife अपने साथ पहले ही ले गई थी।
- कुछ items का ownership/quantity dispute है।
इन सबको एक ही sentence में “मेरे पास कुछ नहीं है” कह देना factual clarity नहीं देता।
हर relative का actual possession और knowledge अलग-अलग verify कीजिए।
किसी relative के behalf पर ऐसी admission मत कीजिए जिसे वह independently verify नहीं कर सकता।
और किसी दूसरे व्यक्ति के possession में रखी property के बारे में बिना जानकारी के categorical statement मत दीजिए।

CAW Cell का objective matrimonial disputes में conciliation की कोशिश करना हो सकता है। लेकिन jewellery या articles की list पर discussion को बिना समझे full-and-final settlement में बदल देना आवश्यक नहीं है।
अगर settlement प्रस्ताव दिया जा रहा है, तो यह स्पष्ट करें:
क्या केवल articles return होने हैं?
क्या monetary compensation भी तय हो रही है?
