MEN CELL Delhi: NRI Husband की Higher Income का मतलब Automatic Maintenance नहीं — Court ने क्या समझाया?

विदेश में नौकरी करने वाले husband को अक्सर यह डर रहता है कि अगर उसकी salary या savings पत्नी से ज्यादा हैं, तो court automatically भारी maintenance दे देगा। लेकिन matrimonial maintenance का legal test केवल दोनों की income compare करना नहीं है। दूसरी तरफ, wife की savings होने का मतलब भी यह नहीं कि maintenance claim अपने-आप खत्म हो जाएगा।

Delhi High Court का 8 October 2026 का फैसला इस distinction को समझने में मदद करता है।

M​​eenakshi Batra v. Vijay Kumar Batra, MAT.APP.(F.C.) 109/2022 में दोनों parties retired Central Government employees थीं। Wife ने Hindu Marriage Act, Section 24 के तहत pending matrimonial proceedings के दौरान maintenance माँगा था। Family Court ने उनका application dismiss किया था, और उन्होंने Delhi High Court में appeal की।

High Court ने दोनों की financial position, recurring income, investments, reasonable expenses और family responsibilities पर विचार किया। Wife की disclosed monthly income pension और investment interest मिलाकर लगभग ₹69,000 थी। Husband ने लगभग ₹1.09 lakh monthly pension, investments और अपनी elderly mother की maintenance तथा medical needs का उल्लेख किया।

Court ने स्पष्ट किया कि retirement corpus को सीधे monthly income नहीं माना जा सकता। उस corpus से मिलने वाला interest या actual investment return income के रूप में relevant हो सकता है। इसी तरह, केवल यह कहना कि husband की income अधिक है, maintenance पाने के लिए पर्याप्त नहीं है। दूसरी ओर, केवल savings या investments होने से applicant maintenance के लिए automatically ineligible भी नहीं हो जाता।

इस particular case में Court ने माना कि wife की independent income और available resources उनकी reasonable needs तथा litigation expenses के लिए पर्याप्त थीं। इसलिए Section 24 के तहत उनका application dismiss करने वाला final outcome नहीं बदला।

NRI husband के लिए इसका practical message: overseas salary, foreign bank balance, investments और living expenses को सही context में document करना महत्वपूर्ण हो सकता है। यदि आप विदेश में रहते हैं और India में maintenance claim का सामना कर रहे हैं, तो केवल अपनी gross salary दिखाना या केवल expenses की लंबी list देना पर्याप्त strategy नहीं है। Actual income, reasonable deductions, liabilities, dependants और supporting documents को व्यवस्थित तरीके से प्रस्तुत करना पड़ सकता है।
