एक husband अपने matrimonial case में अपने advocate पर भरोसा करता है। Court dates, pleadings, applications, settlement discussions और documents—सब कुछ lawyer के through चलता है। लेकिन अगर किसी महत्वपूर्ण stage पर आपको यह पता चले कि आपके नाम से कोई Vakalatnama, settlement या compromise document record पर आ गया है और आपने उसे उस form में authorise ही नहीं किया था, तो problem केवल advocate बदलने की नहीं रह जाती। आपके case record, legal rights, settlement position और future strategy पर सीधा असर पड़ सकता है।

यही वह जगह है जहाँ CAW CELL DELHI या किसी matrimonial proceeding में husband को केवल “मेरे lawyer ने देख लिया होगा” कहकर आगे नहीं बढ़ना चाहिए।

जब Lawyer की authority को blindly assume करना dangerous हो सकता है

24 August 2026 के एक Allahabad High Court matter, Shiv Shankar Singh v. Committee of Management Nehru Vidyapeeth Inter College, में Court ने vakalatnama से जुड़े विवाद में records examine कराए और handwriting/FSL material भी देखा। Court ने कहा कि proper appointment का मतलब genuine, conscious and voluntary authorization है। उसने यह भी discuss किया कि compromise के लिए advocate के पास proper authority होना आवश्यक है।

इस judgment में Court ने Supreme Court के Narain Pandey v. Pannalal Pandey decision को भी refer किया, जिसमें disciplinary findings regarding unauthorized vakalatnamas and fictitious compromises were restored, and the advocate was suspended for three years.

अब इसे अपने matrimonial matter के context में समझिए।

मान लीजिए CAW Cell Delhi, matrimonial complaint, 498A/406-related proceedings, DV proceedings या किसी connected family dispute में आप अपने advocate को documents देते हैं।

आपने कहा:

“मैं अभी settlement के लिए agree नहीं हूँ।”

लेकिन बाद में आपको कोई document दिखाई देता है जिसमें settlement, consent या compromise की language है।

या आपने केवल किसी particular application के लिए signature किया था, लेकिन आपको यह clear नहीं था कि वही document किस purpose से file होगा।

या lawyer कहता है:

“आप चिंता मत करो, मैं सब manage कर लूँगा।”

यहीं से आपकी case strategy की सबसे महत्वपूर्ण checking शुरू होनी चाहिए।

FEAR: Lawyer पर भरोसा अलग है, अपने Court Record को verify करना अलग

Matrimonial litigation में husband कई बार emotionally exhausted होता है।

CAW Cell proceedings चल रही हैं।
Family pressure है।
Police communication आ रहे हैं।
Court dates बढ़ रही हैं।
घर की situation खराब है।
और lawyer कहता है—“बस मेरे ऊपर छोड़ दीजिए।”

लेकिन case आपका है।

अगर कोई document आपके नाम से file हो रहा है, तो कम-से-कम आपको यह पता होना चाहिए कि:

क्या document है?

किस purpose से file हो रहा है?

क्या आपने वास्तव में उस authority को दिया है?

क्या settlement की कोई term आपने accept की है?

क्या compromise में कोई payment, withdrawal, divorce, custody, maintenance या property-related consequence है?

और सबसे महत्वपूर्ण—

Court record में वास्तव में क्या चला गया है?

यही difference एक informed litigant और completely dependent litigant के बीच हो सकता है।

CAW Cell Delhi matter में यह और important क्यों हो सकता है?

CAW CELL DELHI, CAW Cell Nanakpura, Crime (Women) Cell या किसी matrimonial proceeding से शुरू हुआ dispute आगे चलकर police proceedings, matrimonial litigation, maintenance, DV proceedings, criminal proceedings या settlement discussions तक जा सकता है।

हर stage पर document trail अलग हो सकता है।

इसलिए केवल WhatsApp पर lawyer की एक line—
“सब ठीक है”—
आपके लिए sufficient case record नहीं है।

Record देखिए। Document पढ़िए। Authority समझिए। फिर decision लीजिए।

अगर आपने किसी document को केवल “routine formalities” समझकर sign किया है, तो उसकी copy अपने पास रखना और उसके actual use को understand करना भी important है।

सबसे बड़ा डर क्या है?

सबसे बड़ा डर यह नहीं कि आपका advocate कोई mistake कर सकता है।

बड़ा risk यह है कि आपको mistake या unauthorized step का पता बहुत देर से चले।

क्योंकि बाद में argument यह हो सकता है कि document record पर आ चुका है, proceedings आगे बढ़ चुकी हैं, parties ने कुछ conduct किया है, या settlement के terms पर reliance हो चुका है।

इसलिए Delhi matrimonial case strategy में prevention का मतलब केवल FIR से बचना नहीं है।

Prevention का मतलब है:

documents की checking + court record की checking + authority की checking + chronology की checking + lawyer की advice को independently समझना।

अगर आपका advocate compromise की बात कर रहा है

किसी भी settlement / compromise / consent terms / withdrawal / undertaking को केवल इसलिए accept न समझें क्योंकि lawyer ने कहा है कि “यह formal है।”

पहले terms पढ़िए।

अगर आपको समझ नहीं आ रहा है, तो independent legal opinion लेना practical हो सकता है।

और अगर आपको शक है कि कोई document आपकी actual instructions के बिना file हुआ है, तो delay करके केवल verbal assurances पर निर्भर रहने के बजाय record-based legal review कराना ज्यादा sensible हो सकता है।
