Delhi Men Cell: Advocate ने पुराना Case छिपाया तो Court में क्या हो सकता है? - Why take action against lawyer?
आप अपने advocate को पूरी fees देते हैं… लेकिन क्या आप कभी check करते हैं कि Court में आपके behalf पर क्या disclose किया गया है?
यह सवाल uncomfortable है.
लेकिन Delhi High Court के 14 August 2026 के एक judgment में इसी तरह का issue सामने आया — और मामला सिर्फ “गलत drafting” तक नहीं रुका.
In Harjeet Singh Mendiratta v. State Govt. of NCT of Delhi & Anr., W.P.(CRL) 3144/2024, the Court examined allegations concerning suppression of an earlier identical petition.
The earlier petition, CRL.M.C. 3870/2012, had already sought quashing of the same criminal complaint and had been dismissed on 18 December 2012.
When the later petition was filed, the earlier case and its dismissal were not disclosed. The mandatory disclosure paragraph instead stated that no similar petition had previously been filed.
The filing advocate was also personally connected with the petitioner and, according to the judgment, had personal knowledge of the earlier proceedings.
The Delhi High Court treated this very seriously.
The Court recorded that the suppression was prima facie deliberate, that an advocate has a duty to verify the correctness of pleadings, and that the conduct warranted consideration under professional-misconduct and contempt provisions. The matter was directed to be placed before the appropriate Division Bench for contempt proceedings and a reference to the Bar Council of Delhi was considered necessary.
यहीं से असली डर शुरू होता है — client के लिए नहीं, process के लिए.
Imagine a husband or family member thinking:
“मेरे advocate ने file कर दिया है, मतलब सब ठीक होगा.”
फिर बाद में पता चले कि:
पुराना petition था.
पुराना dismissal order था.
एक previous revision भी थी.
Court को पूरी litigation history नहीं बताई गई.
अब problem केवल original matrimonial या criminal dispute की नहीं रहती.
Court का trust भी issue बन सकता है.
और इसी judgment में Court ने earlier proceedings की history भी examine की. The record referred to multiple challenges and earlier observations concerning suppression and misuse of proceedings; at one stage, another revision had been dismissed with costs after non-disclosure of an earlier revision.
इसलिए हर Delhi matrimonial case में एक simple habit बहुत important है:
आपके नाम से क्या file हुआ?
कौन-सा previous case mention हुआ?
कौन-सा order attached है?
कौन-सा fact disclose नहीं किया गया?
क्या advocate ने आपको final petition पढ़ने दी?
क्या Court की previous orders की पूरी chronology सामने है?
क्योंकि Delhi matrimonial litigation, Delhi criminal proceedings, CAW Cell matters, property disputes या family litigation में एक छोटा-looking procedural fact बाद में बहुत बड़ा बन सकता है.
और सबसे dangerous sentence हो सकता है:
“Sir, आप tension मत लो… सब मैं देख लूँगा.”
No client should blindly depend on that sentence.
आपका case record आपका है.
आपकी reputation आपकी है.
आपका money आपका है.
और Court में आपकी position ultimately documents और disclosed facts से भी बनती है.
