MenCell Delhi: Court Fees के पैसे भी Lawyer अपनी Fee में काट सकता है?

कभी आपने Advocate को पैसे यह सोचकर दिए कि “ये Court expenses के लिए हैं” — filing, process, certified copies, court-fee या दूसरे case expenses के लिए?

फिर अचानक पता चला कि वही पैसा professional fee में adjust कर दिया गया?

यहीं client को रुकना चाहिए।

Bar Council of India Rules के Rule 26 के अनुसार, client से fees या expenses के लिए प्राप्त money का account अलग तरीके से record होना चाहिए। और proceeding के दौरान, client की written consent के बिना Advocate expenses के लिए मिले पैसे का कोई हिस्सा अपनी fees में divert नहीं कर सकता।

मतलब बात सिर्फ इतनी नहीं है कि आपने कितने पैसे दिए।

पैसा किस purpose के लिए दिया था — यह भी important है।

मान लीजिए Delhi-NCR में husband के matrimonial case में ₹50,000 “court expenses” के नाम पर लिए गए।

कुछ समय बाद पूछा:

“Court fee और filing का क्या हुआ?”

और जवाब मिला:

“उसमें से ₹30,000 मेरी fee में adjust हो गए।”

अब सवाल उठता है:

क्या आपने ऐसा करने की written consent दी थी?

यही वह जगह है जहाँ छोटी-सी payment detail बाद में बड़ा dispute बन सकती है।

इसलिए Men Cell Delhi से legal guidance लेने वाला कोई husband हो, या Purush Aayog Delhi के बारे में information खोज रहा हो, हर payment का purpose लिखित में रखें।

WhatsApp पर लिखें:

“₹_____ is being paid towards court expenses / filing expenses.”

Receipt लें।

Expense details मांगें।

और अगर fee में adjustment हो रहा है तो written consent और calculation समझें।

क्योंकि litigation में पैसा सिर्फ पैसा नहीं होता।

वही पैसा आपके next hearing, filing, certified copy या procedural step के लिए जरूरी हो सकता है।

अगर client को बाद में पता चले कि case expenses के लिए रखी रकम कहीं और adjust हो गई, तो confusion और financial pressure दोनों बढ़ सकते हैं।

लेकिन एक important caution भी है: हर fee adjustment automatically professional misconduct नहीं है। Rule 26 specifically proceeding के दौरान expenses के लिए received money को fees में divert करने और written consent की requirement से जुड़ा है। Facts, payment purpose और consent का actual record देखना जरूरी है।

Delhi matrimonial dispute हो, property dispute हो या कोई financial litigation — “मैंने lawyer को पैसे दिए थे” इतना पर्याप्त record नहीं है।

आपको यह भी पता होना चाहिए:

कितना दिया?
किसलिए दिया?
कब दिया?
किस account में गया?
कितना खर्च हुआ?
और कितना fee के रूप में लिया गया?

आज की छोटी documentation कल की बड़ी परेशानी से बचा सकती है।
