MenCell.Org Delhi: Wife ने CDR और Hotel Records मांगे तो Husband की Privacy बच सकती है? Supreme Court का बड़ा जवाब
अगर आपके divorce case में wife कहती है कि husband का किसी दूसरी woman से relationship है, तो मामला सिर्फ allegation तक सीमित नहीं रह सकता।
वह Court से यह भी मांग सकती है कि Call Detail Records (CDR), hotel booking records, payment details या दूसरे specific records मंगवाए जाएं।
और अगर आप सोच रहे हैं—
“मेरी privacy है, Court मेरा personal data कैसे मांग सकती है?”
तो इस सवाल पर अब Supreme Court का भी फैसला आ चुका है।

इस matter की शुरुआत Delhi High Court के सामने हुई थी। Wife ने husband पर adultery और cruelty के allegations लगाए और कहा कि husband April 2022 में Jaipur के Fairmont Hotel में दूसरी woman के साथ एक room में रहा था।
Hotel से सीधे records नहीं मिले।
इसके बाद wife ने Family Court से specific hotel booking details, identity documents, payment details और CDRs preserve और produce कराने की मांग की।
Husband ने privacy का objection लिया।
लेकिन Delhi High Court ने माना कि matrimonial adultery cases में direct evidence मिलना अक्सर मुश्किल होता है और particularised evidence—जैसे किसी specific hotel में specific dates की stay details या relevant CDRs—case में relevant हो सकती है।
Records को sealed cover में Court के सामने रखने की व्यवस्था की गई।
फिर husband ने मामला Supreme Court तक पहुंचाया।
2 July 2026 को Supreme Court ने Delhi High Court के decision में interference करने से इनकार कर दिया।
इसका practical message husbands के लिए uncomfortable लेकिन important है:
अगर matrimonial case में specific adultery allegation है और wife particular dates, particular hotel या particular communication records से उसे establish करने की कोशिश कर रही है, तो केवल “यह मेरी privacy है” कहना हमेशा sufficient defence नहीं हो सकता।
लेकिन इसका दूसरा हिस्सा भी उतना ही important है।
इस judgment को यह समझना गलत होगा कि wife को husband की हर private information बिना limitation के मिल सकती है।
Delhi High Court ने evidence को relevant और specific circumstances से जोड़कर देखा था और confidentiality safeguards भी रखे गए थे। Earlier Delhi High Court jurisprudence में भी disclosure को relevant period और particular records तक सीमित करने की बात सामने आई है।
इसलिए अगर आप Delhi divorce case, husband privacy rights, adultery allegation, CDR in matrimonial case, hotel records in divorce case या Delhi Family Court evidence जैसी situation face कर रहे हैं, तो panic करने के बजाय यह देखना जरूरी है कि wife ने वास्तव में Court से क्या मांगा है।
क्या उसने सिर्फ allegation लगाया है?
या उसने specific date, hotel, phone number और particular period दिया है?
क्या Court ने records preserve करने को कहा है?
क्या production sealed cover में होगी?
क्या requested information case से genuinely connected है?
और क्या आप समय रहते उस order को legally challenge कर सकते हैं?
यहां एक गलती बहुत महंगी हो सकती है: Court का evidence-production order ignore करना और बाद में यह कहना कि “मुझे पता नहीं था।”
