पैसों की कमी है तो Court से पीछे मत हटिए — पहले Free Legal Aid की eligibility check कीजिए
एक आदमी का case बिगड़ रहा है।
घर में financial pressure है।
Advocate की fee afford करना मुश्किल है।
और वह सोचता है:
“मेरे पास पैसे नहीं हैं, इसलिए अब Court में क्या कर सकता हूँ?”
यहीं एक important बात बहुत से men को पता नहीं होती।
Legal Aid केवल महिलाओं के लिए नहीं है।
Delhi State Legal Services Authority के अनुसार, eligible persons को free legal services उपलब्ध कराई जाती हैं। इसकी listed categories में annual income ₹3 lakh से कम वाला व्यक्ति, persons with disabilities, industrial workmen, persons in custody और कई अन्य categories शामिल हैं। Senior citizens के लिए अलग income threshold भी specified है।
इसका मतलब यह नहीं कि हर आदमी automatically free Advocate पाने का entitled है।
Eligibility rules apply होंगे।
लेकिन यह जरूर है कि “मैं आदमी हूँ, इसलिए मुझे Legal Aid नहीं मिलेगी” — ऐसा assumption गलत हो सकता है।
Delhi में DSLSA, High Court Legal Services Committee और District Legal Services Authorities के माध्यम से eligible लोगों को legal services उपलब्ध कराई जाती हैं।
इसलिए अगर कोई man financial difficulty की वजह से:
अपना matrimonial matter,
maintenance-related dispute,
property dispute,
civil case,
criminal matter
या कोई दूसरा eligible legal matter properly pursue नहीं कर पा रहा है, तो पहले Legal Aid eligibility check करना समझदारी है।
और एक emotional बात भी।
कई पुरुष केवल इसलिए चुप हो जाते हैं क्योंकि उन्हें लगता है:
“Court जाना बहुत महंगा है।”
“Lawyer की fee कहाँ से दूँगा?”
“मेरी सुनवाई कौन करेगा?”
हर situation में जवाब आसान नहीं होता।
लेकिन कभी-कभी problem पैसे की कमी से कम और available legal options की जानकारी की कमी से ज्यादा होती है।
इसलिए Delhi में Men Cell | Purush Aayog Delhi की legal awareness का एक simple message है:
पहले eligibility check कीजिए।
फिर decision लीजिए।
Legal Aid कोई shortcut नहीं है।
यह हर case में available भी नहीं होगा।
लेकिन eligible व्यक्ति को केवल डर या financial pressure के कारण अपना legal remedy छोड़ देना भी जरूरी नहीं है।
और अगर आपको Legal Aid मिलती है, तो अपने matter की file, orders और facts को फिर भी समझते रहिए।
Free legal service का मतलब यह नहीं कि अपनी responsibility खत्म हो गई।
अपने case को समझना आज भी जरूरी है।
